Terms of Use

Welcome to VILM. These Terms of Use govern your access to and use of the VILM mobile application and related services. By downloading, installing, or using VILM, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using VILM, you confirm that you are at least 13 years old and that you have the legal capacity to enter into a binding agreement. If you are using VILM on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. VILM Pro Subscription & Purchases

Certain features and camera effects require an active VILM Pro subscription or a one-time purchase. All purchases are processed through your Apple ID and managed via your App Store account settings.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You may cancel your subscription at any time through your Apple ID account settings.
• Any unused portion of a free trial period will be forfeited upon purchase of a subscription.
• All prices are displayed in your local currency and are subject to change.
• Lifetime purchases grant access to VILM Pro features for the lifetime of the App or product, not the lifetime of the user or their device.
• Refund requests must be submitted directly to Apple. We do not process refunds ourselves.

3. License and Restrictions

VILM grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. You may not:

• Reverse engineer, decompile, or disassemble the app.
• Distribute, sublicense, or sell any part of VILM.
• Use VILM for any unlawful purpose.
• Interfere with or disrupt the app's servers or networks.

4. User Content

All photos and videos captured with VILM belong to you. We do not claim ownership of your content. You retain all intellectual property rights to your creations.

You are solely responsible for the content you capture, edit, store, and share using VILM. You represent and warrant that any content you create or process through the App does not violate applicable laws or the rights of any third party.

5. Prohibited Content and Conduct

You agree not to use VILM to create, upload, distribute, or otherwise make available any content or to engage in any conduct that:

• Is unlawful, illegal, fraudulent, or promotes illegal activity.
• Infringes any intellectual property rights, privacy rights, publicity rights, or other rights of any person or entity.
• Is defamatory, libelous, threatening, harassing, abusive, hateful, discriminatory, or otherwise objectionable.
• Constitutes child sexual abuse material (CSAM) or sexually exploitative content involving minors, in any form.
• Contains non-consensual intimate imagery, deepfakes, or synthetic media created or distributed without the explicit consent of the identifiable individuals.
• Promotes violence, self-harm, terrorism, or dangerous organizations.
• Contains malware, viruses, or any code intended to disrupt or compromise systems.
• Impersonates any person or entity or misrepresents your affiliation with any person or entity.
• Involves unauthorized scraping, data mining, or automated access to the App or its infrastructure.

We reserve the right, but have no obligation, to review content created with VILM and to suspend or terminate your access if you violate these restrictions. Because VILM processes media locally on your device, we do not routinely monitor your content; however, we may act on credible reports of abuse or illegal conduct.

Video Traceability. To help us enforce these Terms and cooperate with law enforcement when necessary, every video exported from VILM includes an anonymous installation identifier in its metadata (com.vilm.installationID). This identifier is a random UUID generated on your device. It is not linked to your name, Apple ID, or any other personal information by default. It is stored locally in your device’s Keychain and is only used by us if a video is reported to us as violating these Terms or applicable law.

You may optionally provide an email address in the app’s Settings. If you do so, this email is associated with your installation identifier and stored locally on your device. By providing an email, you consent that we may use it to contact you in the event of a legal issue, abuse report, or law enforcement request related to content you have created with VILM. You may remove or update this email at any time in the app’s Settings.

6. Intellectual Property

VILM, including its code, design, trademarks, and visual effects, is the property of Arno Partissimo and is protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works from VILM without prior written consent.

7. Copyright Infringement and DMCA Takedown Notice

We respect the intellectual property rights of others. If you believe that content created or distributed using VILM infringes your copyright or other intellectual property rights, please contact us at hello@vilm.app with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the infringing material and information reasonably sufficient to permit us to locate it.
• Your contact information, including address, telephone number, and email address.
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We will review and respond to properly submitted notices in accordance with applicable law. We reserve the right to remove or disable access to any content that we determine, in our sole discretion, violates these Terms or any applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Arno Partissimo, VILM, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your access to or use of VILM.
• Your violation of these Terms or any applicable law.
• Your violation of any third-party right, including any intellectual property, privacy, or publicity right.
• Any content you create, upload, share, or otherwise make available using VILM.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

9. Disclaimer of Warranties

VILM is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the app will be error-free, uninterrupted, bug-free, or meet your specific requirements. We do not guarantee that any content created with the App will be saved, preserved, or exported successfully.

10. Data and Content Backup

All photos and videos captured with VILM are stored locally on your device unless you explicitly save them to your Photos library or export them.

You are solely responsible for backing up your content. We strongly recommend that you regularly save important videos and photos to your Photos library or another secure storage location.

We are not responsible for any loss, corruption, deletion, or failure to save content created with the App. This includes, but is not limited to, losses caused by:

• App bugs, crashes, or technical failures.
• Device malfunction, damage, theft, or loss.
• Uninstalling the App or clearing the App's data.
• iOS updates or device resets.
• User error, accidental deletion, or failure to export content.

11. Limitation of Liability

To the maximum extent permitted by law, VILM and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, content, or profits.

12. Service Availability

We reserve the right to modify, suspend, or discontinue the App or any part of the Service at any time, with or without notice. This includes the addition, modification, or removal of camera effects, features, or the entire App.

If the App is discontinued, we will make reasonable efforts to allow users to retain access to previously purchased content where technically possible. However, we cannot guarantee the continued availability of the App, its features, or any content associated with your purchases.

We are not liable for any loss or inconvenience caused by the discontinuation, modification, or unavailability of the App or any of its features, including paid subscriptions or lifetime purchases.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of VILM after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
